The bill creates licenses for producers and distributors.
It also allows adults 21 and older to buy cannabis from authorized sellers, and possess up to 3 ounces of cannabis and 24 grams of cannabis concentrate. And, 18 months after sales first begin, it allows them to grow at home up to six mature plants and six immature plants at home per household.
the nys law is definitely unique and welcomed but the devil is in the details, and, when it comes to cannabis law, the devil is in the formation and implementation process.
6 total plants for home grow is good (the national average is ~7 mature), so is a stated focus on small businesses through rolling and accessible license types, such as delivery and online sales, but perhaps the most important component of the nys law surrounds racial equity and restorative justice. the majority of the tax and reg laws in the 16 states with an adult-use market were legislatively driven by a corporate trade association called the Marijuana Policy Project, they are the ALEC of the cannabis industry. yes, legal cannabis is a billion $ industry and has special interests. MPP practices regulatory capture, they don't give a fuck about equity or restorative justice and are largely responsible for the terrible 4.3% BIPOC business ownership rate in the emerging industry. so, the fact that nys has acknowledged and is attempting to redress through statute is seen as a giant milestone for the industry, their automatic expungement mirrors that of Illinois, performed at the executive level, cost-free and without requiring court surcharges as criteria for eligibility – all this is good.
some of the criticisms of the nys law include – it does not touch their medical program, which is usually a red flag for regulatory capture, it forms an unelected 5 person commission which has details yet to be defined that can tip the market in favor of the big actors, and it includes a myriad of provisions that can be turned into market delays for small businesses at rollout.
the nys law is much more sophisticated and progressive than vermont's new law.
