Yes and it has been upheld again and again all the way up to the Supreme court. There was one dissent from Thomas on a case that was upheld that gives her enough cover where she will be overturned months from now, but not dismissed from the case.
That said this case, and the recent SCOTUS ruling giving Trump immunity shows that the Constitution is nothing more than toilette paper now.

As for the Supreme Court, they are on a tear too. But if there is any silver lining, it is for the publishers of law school text books who will have to come up with brand new editions before the upcoming school year.
