I don't see this getting approved but the PTO has been such a mess lately that who knows?

Got to admire old Gene for even trying, the guy knows his business.

I think that's legally irrevelant as the trademark doesn't apply to that arena.

Simmons is claiming the hand gesture mark for "entertainment, namely, live performances by a musical artist; personal appearances by a musical artist."

You have to assume a great deal of prior use, which in itself is usually grounds for rejection (it makes it generic).  And someone mentioned to me that it's the ASL for "I love you" which, if true, would also cause a lot of problems.  Can you see Gene suing Sesame Street because some deaf character uses it?

Then use the drop down menu to choose "Serial or Registration Number" and enter 87482739.

He lists 11/14/74 as the date of first use (which is what really matters with trademarks).  I wonder how he can back that up and why he choose that date?  Was that the first time KISS performed live?

College Football is clearly a form of entertainment, so i think Nanc should contact Texas and tell them to press charges immediately.

The picture in the first post is not the same as the Texas Longhorns "hook em horns" salute though, so there's that to consider as well.

Trademark, not patent.  You can't patent a word or phrase.

There is a registered mark for that phrase, owner listed as Riles & Company, Inc.

I don't think there's any rock and roll on that album.

Gene Simmons is a master of branding. The odds of him being granted the patent are about zero to none.

The odds of the Innerwebz and news blowing up and talking about both him and Kiss are pretty damn high. He has just put himself back in the news, and a guarantee that sales of Kiss merchandise have just risen.

Trademark, not patent.  Let's keep our intellectual property straight here folks.

I'm old enough to remember when Gene wanted to trademark the use of the word Axe in reference to a guitar..he's just regurgitating old publicity stunts.
