Collusion isn't a crime, but soliciting a thing of value from a foreign power in connection with a federal election is. Question is whether opposition research is a "thing of value." If it is, Trump just admitted his son committed a felony.
Campaigns may not solicit or accept contributions from foreign nationals. Federal law prohibits contributions, donations, expenditures and disbursements solicited, directed, received or made directly or indirectly by or from foreign nationals in connection with any election — federal, state or local.
I hope you aren’t treated too unfairly after the regime change.
There is also the "knowingly and willfully" requirement for criminal penalties to apply. See 52 USC 30109(d) (setting forth criminal penalties for violation of federal campaign finance laws). In the case of the "turn out model" referenced in the indictment cited above, you would still have to prove the Trump person knew they were dealing with a foreign agent as opposed to a domestic hacker. However, with the dirt on Clinton solicitation meeting in Trump Tower, there is no question about whether Don Jr. and Co. knew they were dealing with the Russians.
Again, it will all turn on whether opposition research is a "thing of value" as that term is used in 52 USC 30121(a)(1)(A). I doubt we will get a final ruling on that specific issue without a trip to the US Supreme Court.
That's something I have to keep reminding many of my clients. In the Mueller case, more power to him and hope he strikes gold. However, I am concerned that many people have convinced themselves that they will be seeing Trump hauled away in handcuffs in the near future, especially those who watch a lot of late night comedy or live in a liberal media bubble. Why that is concerning is that there is less than three months until the critical mid-term elections and if people feel that Mueller is a white knight who will slay the Trump dragon and restore peace to the kingdom, they might not be motivated to do everything they can to ensure the GOP loses one of the chambers of Congress in November.
